Please help!!!
My boyfriend was involved in an accident on his motorbike last year. The motorbike is more or less a write off, only fit for selling parts. The insurance company took the bike off his hands in April last year but he kept hold of the log book.
The company has not yet decided who’s fault the accident was, therefore not paid any money out for the bike as yet.
My boyfriend recently found out that the bike had been sold on in December last year. This would have been without my partners consent / permission and without the log book. He has still seen no money.
where does he stand with this situation as his intentions were to get the bike back to fix or sell for parts if he did not end up getting a pay out. Obviously he cannot do this now as the bike has been sold.
Have the insurance company broken any laws?
Can he get the ammount that the bike was evaluated at?
What is the best route for him to take? Legal action?
Please help we need advice, very angry and upset!!

Yeah, they pulled that crap on me too. Except in my case they actually had it removed from the garage before paying out or even telling me it was being written off, and without my knowledge; technically theft.
It was a similar situation, in that it was a multiple vehicle accident which they’re probably still arguing about and I wasn’t even involved. The bike was parked on the street, van pulls out without looking, taxi swerves, hits the van door, crumps into a line of bikes and knocks mine and three others over.
The only thing I bothered arguing about with my insurer (Bennetts; don’t touch them with a shitty stick) was when the paid out they actually had the neck to deduct my excess from the payment; when I wasn’t even involved in the crash. After a rather blunt phonecall I got it.
Difference is, though, I actually got the money.
I’m sorry, I’ve got nothing better for you than find your local CAB, or, and this is a guess, really, look for help from MCN newspaper or any other biker publication. They tend to be staffed by bikers who have all had runs in with insurance and coppers so they won’t be slow to help if they can.
Looking at a motorbike but cant find insurance companys that insure this make?
