My nephew pulled out in front of a motorbike and the biker got a claim of 58000euros which was paid to him in 2007 now the thing is my nephew was not insured to drive my car and took my car with out my permission and this has been stated he lived with me here in Dublin but now he is back at home which is the UK am i liable the insurance company wants me to pay back the 58000euros they paid out and if i don’t pay up they will bring me to the high court what do i do

I don’t know about Irland but in the US the car is covered no matter who is driving it unless they are unlicensed and driving with your knowledge. If you get a judgment here you can file bankruptcy on it and it won’t be worth the paper it is written on.

As he took your car without permission, he stole your car and should have been charged by the police. Thus you are not liable and motorcyclist should have been paid from criminal damages purse and not by your insurance. Your insurance should just have paid to repair your car unless you are not telling us everything.
