I was in a motorbike accident where the other party has been found at fault. The other party’s' 25k coverage barely covers my medical bill, lost wages and rental fee. I separated my shoulder in the accident. I have underinsured coverage up to 50k and am wondering if I can ask my insurance company for pain and suffering for my claim. This accident happened in CA.
Usually you can. The idea of UIM is to pay for ALL the damages that should have been paid by the other driver including pain and suffering. However you should probably involve a lawyer as it may take some tough negotiating to get your best deal. You will be suprised at how big a differance it makes, even after they take their fee.

Yes. File a claim with your carrier immediately. You're company will always pay for your meds (providing you have Medpay on your policy)
Call your adjuster and discuss what exactly your policy does or does not cover.

No. Your policy's un/underinsured coverage covers actual damages only if the other guy has no insurance or picks up if the other guy's limit is reached.
If you want pain and suffering, you'll need to see on the world's lowest life forms-a lawyer. The fee is usually one third of any recovery plus court costs. You'll see some cash in a couple of years at the earliest.
